Terms of Service
Last updated: 12 October 2026
These Terms of Service ("Terms") apply when you sign up for or use Message Every Lead ("MEL", "we", "us" or "our").
By signing up for MEL or using the service, you agree to these Terms.
What MEL does
MEL provides an automatic missed-call messaging service for businesses.
When correctly configured, your existing business mobile continues to ring normally. If a call is genuinely missed, MEL can trigger an automatic SMS from the business mobile number you have verified for the service.
Callers can reply to that SMS normally, and replies are intended to return to the same business mobile's usual messaging service.
MEL may also use repeat-message protection and other operational safeguards to reduce unnecessary duplicate messages.
MEL is not an AI receptionist, call centre, CRM, marketing automation platform or replacement telephone service.
Your existing phone service
MEL works with telecommunications services provided by third parties.
You remain responsible for:
Maintaining an active and compatible mobile or telephone service.
Any charges imposed by your mobile carrier.
Providing accurate carrier and phone information.
Completing any required call-forwarding or phone setup steps.
Telling us if you change carrier, phone number or another setting that may affect MEL.
We may assist with setup, but your mobile carrier remains responsible for its own network and services.
Setup and testing
You agree to provide information reasonably required to configure MEL and to confirm that you are authorised to use and verify the business mobile number supplied.
Activation may require you to confirm control of the mobile number and enable your carrier's No Answer / When unanswered call forwarding to MEL's routing number.
Before MEL is marked live, you should complete the test process we provide to confirm that:
A genuine missed call triggers the intended message from your verified business mobile number.
A reply to that message returns to your usual business mobile messaging service.
You should contact us if MEL does not appear to be operating correctly.
Your missed-call message
You are responsible for the message content you ask MEL to send on your behalf.
Your message must not be unlawful, misleading, deceptive, threatening, abusive, discriminatory, fraudulent or otherwise inappropriate.
MEL must not be used to send unsolicited bulk marketing or spam.
We may refuse or require changes to message content where reasonably necessary to comply with law, telecommunications requirements, provider policies or to protect MEL, customers or other people.
Repeat-message protection
MEL may use duplicate-message protection to reduce repeated automatic texts to the same caller within a configured repeat window.
This control reduces unnecessary repeat messages but does not guarantee that an automatic message will never be sent unexpectedly.
Availability and telecommunications limitations
MEL relies on telecommunications networks, mobile carriers, hosting providers and other third-party infrastructure.
Although we aim to provide a reliable service, we cannot guarantee that MEL will be uninterrupted, error-free or that every call or SMS will be successfully detected or delivered.
Delays or failures may occur because of network outages, carrier behaviour, phone configuration, call forwarding, provider outages, technical faults or circumstances outside our reasonable control.
Nothing in these Terms excludes rights or guarantees that cannot lawfully be excluded.
Price and billing
Unless otherwise agreed, MEL is offered for $49 per month.
Your subscription is billed on a recurring monthly basis using the payment method provided during signup.
You authorise us or our payment provider to charge the applicable subscription amount when each billing period begins.
If a payment fails, we may ask you to update your payment method and may suspend the service if payment remains outstanding.
Cancelling MEL
You may cancel your MEL subscription at any time.
Unless consumer law requires otherwise, cancellation takes effect at the end of your current paid billing period and you will not be charged for another billing period.
We do not generally provide partial refunds for unused portions of a billing period where the service has been supplied as agreed.
This does not limit any refund, cancellation or other remedy you may be entitled to under Australian law.
Price and plan changes
We may change MEL's pricing, plan structure, service inclusions or usage allowances in the future where reasonably necessary as the service develops.
If a change materially affects an existing customer's price or the service included in their subscription, we will provide reasonable notice before the change takes effect.
Changes will not apply retrospectively to amounts already paid.
If you do not wish to continue under a material change, you may cancel before the change applies without a cancellation penalty.
Australian Consumer Law
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot legally be excluded under the Australian Consumer Law or other applicable legislation.
Where MEL fails to meet a guarantee that applies to you, you may be entitled to remedies provided by law.
Your account and information
You must provide information that is reasonably accurate and current when setting up MEL.
You are responsible for ensuring that you have authority to configure MEL for the business and phone number you provide.
You must notify us if you become aware of unauthorised access, misuse or a security issue affecting your MEL service.
Acceptable use
You must not use MEL:
For unlawful, fraudulent or deceptive activity.
To harass, threaten or abuse another person.
To send unsolicited bulk messages or prohibited marketing.
To impersonate another person or business.
In a way that interferes with telecommunications networks or other MEL customers.
To attempt to gain unauthorised access to MEL systems.
In a way that breaches applicable law or telecommunications-provider requirements.
Suspension or termination
We may temporarily suspend or restrict MEL where reasonably necessary because of:
Unpaid subscription charges.
Misuse of the service.
A material breach of these Terms.
Fraud or a security risk.
A legal or regulatory requirement.
Requirements imposed by a telecommunications or infrastructure provider.
Where reasonably practicable, we will give you notice and an opportunity to resolve the issue.
We may terminate the service where a serious breach cannot reasonably be resolved or where continuing to provide the service would be unlawful or technically impracticable.
You remain free to cancel MEL as described above.
Changes to MEL
We may improve, update or change MEL over time.
We will not intentionally make a material change that substantially removes the core service you are paying for without reasonable notice.
If a material change significantly reduces the service available to you, you may cancel before that change takes effect.
Customer content
You retain ownership of business information, message wording and other content you provide to MEL.
You give us permission to use and process that information only as reasonably necessary to provide, operate, secure and support MEL and as described in our Privacy Policy.
MEL intellectual property
MEL and its underlying software, branding, systems, processes, designs and other intellectual property remain owned by us or our licensors.
Using MEL does not transfer ownership of that intellectual property to you.
Privacy
Our handling of personal information is described in our Privacy Policy.
By using MEL, you acknowledge that providing the service may require information to be processed by telecommunications and other service providers, including providers operating outside Australia, as described in that policy.
Liability
Nothing in these Terms excludes liability or rights that cannot legally be excluded.
To the extent permitted by law, MEL is not responsible for losses caused solely by events outside our reasonable control, including failures of telecommunications carriers, internet services, third-party infrastructure or customer phone configuration.
You are responsible for deciding how quickly to respond to callers and whether a caller becomes a customer. MEL does not guarantee that a missed-call message will generate a lead, sale, booking or other commercial result.

Changes to these Terms
We may update these Terms as MEL changes or as legal, regulatory or operational requirements change.
For material changes affecting existing customers, we will provide reasonable notice where appropriate.
Changes will not remove rights you already have under applicable law.
Governing law
These Terms are governed by the laws of Queensland, Australia.
Nothing in this section prevents you from exercising any rights you have under applicable Australian consumer law.
